The course will explore the domain of contemporary digital democracy. It aims to comprehend and critically reflect on democratic experiments in the digital sphere acknowledging benefits, recognising risks, and embracing ambivalences. It will cover democratic innovations on websites and social media platforms alike. It views digital democracy as a particular form of general democracy via the optics of focused theories, concepts, and empirical findings. Also, the course considers hybrid online-offline formats and the links of digital phenomena with real-life political and policy processes. The course aims to examine multiple civic tech such as e-initiatives, e-petitions, e-campaigns, e-consultations, e-drafting, e-polling, e-voting, e-referenda, e-elections, e-participatory budgeting, and e-games. We will review both government- and civil society-administered digital democratic initiatives. We will devote significant attention to country-specific and transnational case studies such as examples from Estonia, Ukraine, and the European Union. Overall, the course will incorporate scholarly and practitioner perspectives with insights and frameworks for an informed civic position as well as academic, non-profit, political, or entrepreneurial career tracks in digital democracy.

The study of Administrative Law involves examination of the legal rules and institutions through which government decision-making is authorised, controlled, and challenged. This course examines the legal principles that regulate the exercise of executive power by administrative agencies and officials, and the means by which administrative decisions can be supervised, controlled and challenged. It explains the role of tribunals in providing merits review and the role of the courts in undertaking judicial review (which is a key vehicle in promoting the rule of law). Particular attention is paid to the grounds for judicial review and the consequences of unlawful decision-making. Consideration is also given to the role of independent statutory agencies such as the Ombudsman and anti-corruption bodies in investigating individual complaints about government decision-making as well as undertaking investigations into systemic problems in administration. Means of accessing information held by the administration are also evaluated.

Administrative Law is a compulsory course that builds on what you will have already learnt in Principles of Public Law LAWS1141 (formerly Public Law LAWS1140). The principles covered in this course themselves form the foundation for many other subjects, including Constitutional Law, Industrial Relations Law, Human Rights Law, Environmental Law and Migration/Refugee Law. The aim of the course is to ensure that students are familiar with the central principles of Administrative Law. Students completing the course will develop an appreciation of the relationship between law and government decision making, including how the law forms a framework that enables and controls government activity within the broader context of the rule of law. Students will learn the principles and procedures for review of administrative action, and learn to apply this understanding to resolve practical problems.

Administrative Law is a compulsory subject in the Bachelor of Laws program offered by the Faculty of Law. The subject examines the nature and scope of judicial and administrative review of government decisions and actions, at both the federal and state level. Topics include access to government information (freedom of information and access to reasons), ombudsman, merits review tribunals and judicial review under the Constitution/common law and statute. Emphasis is placed on the development of legal writing and drafting skills.

Spanish B2 level is required.
